News@lemmy.world•DOJ’s No. 2 Official Asks Lawyers to Join ‘War’ Against Judges
10·4 days agocalled on young conservative lawyers in the audience to join the fight against so-called “activist judges.”
Ah yes, young conservative lawyers. The cream of the crop that presumably also helped put this case together: James Comey case ‘coming apart at the seams’ as crucial evidence collapses: report
Prosecutors claim Comey lied during 2020 Senate testimony when he denied authorizing an anonymous FBI source to speak to news outlets about the bureau’s Hillary Clinton investigation — with the alleged source being identified as attorney Dan Richman. But newly revealed documents show Richman wasn’t even employed by the FBI at the time — and that glitch has the government’s case “coming apart at the seams,”
“It’s a war, man,” Blanche, the deputy attorney general, told judges and lawyers And he put out a call to young lawyers, who are “hungry and thirsty,” to join the Justice Department and the fight.

Pointing out the DOJ fabricated evidence must be more “judicial activism.”

1·4 days agoSo the comment that you replied to, was in response to a comment arguing that Vance is correct in claiming judges have no authority over Trump, and that Vance’s claim is proven by the fact that they “haven’t done chicken shit” in response to anything Trump has done.
When some of the chicken shit that they have done, proves that they do indeed have some power and authority (not unlimited because that’s not how checks and balances work) no big deal, just ignore that and pivot to arguing that even if they do have some authority and do something it’s not enough. So rather than just admitting Vance is full of shit, it becomes an argument that since they don’t do enough to stop him, or have enough power to just over throw the president and the executive branch of the federal government (while apparently just ignoring that judges have undeniably created some road blocks and barriers to keep Trump from fully overthrowing the entire federal government using the authority of the executive branch), they might as well be doing nothing.
How convenient that would be for the executive branch, and the administration you allegedly oppose, if everyone just agreed to accept the bullshit argument that the rest of the federal government might as well not even exist because it wouldn’t make a difference anyway.
Nobody is calling what is going on with SNAP a “win” for the courts. Even though the propaganda you’re trying to spread relies on people believing that it can only be one of two things a win or a loss, the reality is there is no “winner.” This is not a win for the courts, but it’s also not a win for Trump. It’s another speed bump.
A fascist was elected president by a majority of the ~30% of the country who actually bothered to show up and vote. Setting aside who should have/could have done what differently, that is why he’s president. He was elected, and presidential immunity existed before Trump ever abused it. Judges cannot uphold the rule of law, and ignore a preexisting law just because of circumstances. All they can legally do is rely on using existing checks and balances that remain to try to impede him and slow down the damage he does.
At the same time, because of the checks and balances which you argue “do nothing,” the president does not have unchecked executive authority, even if he does have more authority than any fascist ever should.
If he did indeed have unchecked authority, there would be no need for his administration to request any appeals in response to a judge’s ruling, no reason for Vance to spread false propaganda that judges have no authority over the president, and no reason for people like you to try and help him spread that bullshit by continuing to repeat the false narrative, that since the rule of law can’t stop him from doing everything, it doesn’t do anything.

News@lemmy.world•Vance Seriously Claims Courts Have Less Power Over Trump in Shutdown
1·4 days agoHere is the step by step reality of what is actually happening:
-
As a bargaining chip, Trump said he wouldn’t be funding SNAP at all until the shut down was over. Allegedly the budget just didn’t exist due to the shutdown.
-
Last week, one of the U.S. district judges who apparently aren’t doing “chicken shit,” (McConnell) ordered the USDA to use $4.65 billion in emergency funding to partially cover SNAP benefits for November. The Tump administration back peddled, and already agreed to provide the partial funding (a little over half the funding necessary for the entire month). That’s why even conservative states like my own quietly released more partial funding on the 7th (but shhh 🤫 that kind of destroys the entire argument judges have no power).
Why did the Trump administration back peddle and agree to even partially fund SNAP? Probably because between those no king rallies that “aren’t doing anything,” and the sweeping victories of Democrats across the nation this past week, the GOP are understandably a little spooked. Especially considering one of the no king rallies that “aren’t doing anything,” took place in a conservative TN district that also voted Democrat in their local election last week (despite very strong support for Trump in the 2024 presidential election).
-
After Trump’s administration agreed to fund half of the SNAP budget, on Thursday of this week, judge McConnell issued a new order that the USDA to use a separate department program that has $23.35 billion in funding from tariffs that support child nutrition, to make up the shortfall and pay the full amount for the month (~$8.5 to $9B total) by a deadline on Friday.
-
On Friday, JD Vance and other like minded individuals seemed to suddenly forget the administration already agreed to follow the chicken shit judges orders to partially fund SNAP, and Vance went on TV to remind America that judges aren’t the boss of the president.
What’s most interesting to me is that in order to buy Vance’s propaganda, you have to believe that Trump is both somehow above judicial rule, but also a victim of crooked partisan judges who are using their authority (that they don’t have?) to pick on the poor almighty ruler.
So instead of just using his magic wand to do whatever he wants, the Trump administration asked the 1st circuit to halt McConnell’s order to fully fund SNAP. (Some might argue that partially funding SNAP after saying there would be no funding, already proves the chicken shit judges are doing “something,” but to do that you would also need to admit the administration has somehow already been partially reigned in by the chicken shit judges who do nothing and hold no power over the magical king president.)
-
The administration also appealed to the 1st circuit. The 1st circuit denied their request for an administrative stay (so the deadline was still the deadline). They have yet to make a decision on the formal request, but the panel of 3 democratic judges said they will be doing so as quickly as possible.
-
Since the 1st circuit denied the administrative stay, the USDA issued the memo you’re dismissing, saying they agreed to fund SNAP in full. However, in order to kick the can a little further down the road, or at least score some “victim of judicial abuse points,” they could later reference on Fox News this weekend, the administration then requested an emergency stay from the supreme court.
Although it’s obvious what the decision would have been if a democratic president was asking for this emergency stay in a district where the case was being decided by a conservative justice, Justice Ketanji Brown Jackson surprised everyone by destroying their go to argument of “politicized judicial abuse,” and instead granted the Trump administration a temporary stay which will expire after the lower “chicken shit” court gives their final ruling, (and most likely will just enforce McConnell’s original rule).
In other words, the administration did all of this, to have courts reach the same decision and force them to fully fund SNAP, but they do get to ignore the Friday deadline to provide full funding. Behold the almighty king’s rule, and tremble at the chaos that has been laid out before you!
So yes, the main take away here is clearly: chicken shit judges have no power to do anything (as long as you ignore what they’ve already partially done and will make a final decision about fully doing soon), nobody can tell the president what to do (except for the chicken shit judges who apparently can’t do anything except what they can do, but are also somehow welding their useless but mighty power to abuse the almighty rule of the king who cannot be stopped by those judges), and the No Kings protests don’t do anything either (except spread public awareness, win elections for the opposition, and scare the GOP into backing down from their original threats).

News@lemmy.world•US Supreme Court lets Trump withhold $4 billion in food aid funding for now
40·4 days agoI know there’s 100 articles posted about this already.
I added this one bc I feel like it does a good job explaining the convoluted series of decisions and appeals that led the administration to file the emergency appeal with SCOTUS.
Once again the victims of a crooked judiciary system cried political attack, and asked for an emergency order they probably assumed wouldn’t be granted by a SCOTUS judge who was appointed by the crooked demoncrats.

2·4 days agoOk then, you do that.
Keep pushing that all or nothing doomerism propaganda. As long as you don’t get oddly defensive when somebody calls you out for it nobody will suspect a thing.
Also, since you’re clearly so passionate about this, and understand the “chicken shit” judiciary system so well, I’d love to hear what you think the ruling means for SNAP? Like this the final say right?
I know it’s kind of inconvenient for your doomerism narrative to acknowledge, but is this really the king getting his way? Because, usually when an all powerful king makes a declaration it’s game over. Is this game over? Please explain to me what the judge granting this stay actually means.

That’s also why he needs his lap dog to lie and make claims about his power. That way he can claim his political enemies are the ones breaking the law by upholding it.

I think in general, grades are not always a great predictor of overall competence/skill in a career. I would take a doctor/lawyer/whatever professional with a few Cs on their record over one with a 4.0 that lacked empathy, self awareness, and common sense.
I’m pretty sure Peter Thiel made really good grades in undergrad and law school, and attended ivy league for both. I’m sure there are tons of guys just like him in the federalist society, but if I had to choose between trusting Thiel or trusting a lawyer who graduated from the University of American Samoa, I honestly can’t say that Thiel would be the safe pick in the scenario.
Of the current nine members of the Supreme Court of the United States, five are current or former members of the federalist society—Brett Kavanaugh, Neil Gorsuch, Clarence Thomas, Samuel Alito, and Amy Coney Barrett.
